1. Introduction

These terms and conditions govern your use of the website at lovemercyandhope.com and any donation, purchase or booking made through it. By using the website or making a payment you agree to these terms. If you do not agree, please do not use the website.

2. About us

LOVE, MERCY, HOPE is a Charitable Incorporated Organisation registered with the Charity Commission for England and Wales under charity number 1186224. Our registered office is DG House, 6A Little Tennis Street, Nottingham NG2 4EL. We trade as Love Mercy Hope. You can contact us by email at info@lovemercyandhope.com or by telephone on 01332 416072.

3. Donations

You may make a one-off donation to the charity through the website by debit or credit card. When you donate you confirm that you are the cardholder or have the cardholder’s authority.

Donations are processed in pounds sterling unless another currency is offered at checkout. Where a currency conversion applies, the amount charged to your card is determined by your card issuer and may differ slightly from the amount displayed.

We will send an acknowledgement of your donation to the email address you provide. If you are a UK taxpayer you may choose to add Gift Aid, in which case we will reclaim the basic rate of tax on your donation from HM Revenue and Customs. By making a Gift Aid declaration you confirm that you have paid or will pay enough UK income tax or capital gains tax in the relevant tax year to cover the amount reclaimed on all your donations to charities.

We operate a 100% donation policy. Donations made to our appeals are applied in full to charitable activity, and our administrative costs are met from Gift Aid income.

4. How donations are used

Donations made to a specific appeal are applied to that appeal. Donations made to Sadaqah, Where Most Needed or general funds are applied at the trustees’ discretion in furtherance of the charity’s objects.

Zakat donations are held and distributed in accordance with Zakat principles and are not used for administrative purposes.

Overseas projects are delivered through partner organisations operating under written agreements with the charity. Funds are released to partners in stages against agreed project plans, and partners report to the charity on delivery.

5. Recurring donations

You may set up a recurring donation to be collected from your card monthly, or at any other frequency offered on the donation page, on or around the same date each period. By setting up a recurring donation you authorise us and our payment processor to collect the chosen amount at the chosen frequency until you cancel.

You may change the amount or frequency of a recurring donation, or cancel it, at any time by contacting us at info@lovemercyandhope.com. Changes and cancellations take effect from the next scheduled collection, provided we receive your request at least three working days before that date. No further payments will be collected after cancellation, and any payment already collected will not be refunded unless section 6 applies.

If a recurring payment fails, for example because your card has expired or has insufficient funds, we may attempt to collect it again within the following seven days. If collection continues to fail we will suspend the recurring donation and notify you by email. We will not charge you for failed collections.

We will notify you by email at least 14 days before any change to the terms on which recurring donations are collected.

6. Donation refunds

Donations are gifts and are not normally refundable. We will, however, refund a donation where:

  • the donation was made in error, for example an incorrect amount was entered or the same donation was made more than once;
  • the donation was made without the cardholder’s authority; or
  • we are required to do so by law.

To request a refund, contact us at info@lovemercyandhope.com within 14 days of the donation, quoting the date, amount and the email address used. Refunds are made to the card used for the original payment, normally within 10 working days of approval. Where Gift Aid has already been claimed on a refunded donation, we will repay the Gift Aid to HM Revenue and Customs.

If you have a concern about a transaction, please contact us before raising a dispute with your card issuer so that we can resolve it directly.

7. Acceptance of these terms

Before completing a donation or purchase you may be asked to confirm that you have read, understood and accepted these terms and conditions. The box is unticked by default and must be ticked by the cardholder. In any case, you must read and accept these terms and conditions to donate to the charity.

8. Privacy

We collect, store and process your personal data in accordance with UK data protection law. Your information is used to process your donation or order, to send acknowledgements and receipts, to administer Gift Aid, and, where you have agreed, to keep you informed about our work. 9. Complaints

If you are unhappy with any aspect of our fundraising or your dealings with us, please contact us at info@lovemercyandhope.com. We will acknowledge your complaint within five working days and aim to respond in full within 20 working days.

10. Governing law and jurisdiction

These terms and conditions, and any dispute or claim arising out of or in connection with them or with any donation, purchase or booking made through the website, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts. Nothing in these terms affects your statutory rights.

11. Changes to these terms

We may update these terms from time to time. The version in force at the time you make a donation or purchase is the version that applies to it. The date of the latest revision is shown below.
